Florida Man Wants Cheese In His Combos Snacks and He Will Sue You To Get It
It’s National Snack Food Month and what better way to kick it off than with a lawsuit by Florida Man because his Combos snacks don’t have enough cheese in them?
There are lawsuits, there are frivolous lawsuits, and then there are frivolous lawsuits brought by Florida Man.
FLORIDA MAN STRIKES AGAIN!
DATELINE – Fort Myers and the Saga of Florida man Edward Pistorio.
First, let me tell you that February is National Snack Food Month. So in honor of that, Pistorio has filed a federal lawsuit against the parent company of Combos snacks, arguing that they are being deceptively marketed because they don’t contain enough real cheese.
Now, if you’ve seen the packaging, you know that there is a picture of a large block of cheese and the labels “Filling made with REAL CHEESE” and “Natural Flavors.”
Well, Pistorio cites the ingredients list, which says the snacks are less than 2% cheese blend. According to the label included in court documents, the main ingredients of the snack are wheat flour, palm oil, dairy product solids, carbohydrates and corn starch.
Pistorio’s attorney said that “More than half the public consider cheese ‘healthy’ and “nutritious” because it is high in protein and nutrients with key vitamins and minerals like calcium.
The attorney went on to argue that “By replacing real cheese with palm oil and dairy product solids, the filling lacks the quality, nutritional and savory attributes that consumers expect from a label indicating a ‘filling made with real cheese.'”

Can you imagine being the judge in this case, sitting there and watching all of this play out in front of you?
The lawsuit also says that the “real cheese” labeling is a factor in the price of $2.59 a bag, which is also misleading and hurtful to consumers.
It’s a class action lawsuit, by the way, demanding that Combo’s parent company, which is Mars Inc. pay damages for the alleged deceptive marketing and “other relief, as the court deems just improper.”
Again, I don’t know what this judge is thinking. I don’t know how he or she will rule, but it is certainly an interesting way to kick off National Snack Food Month.
